Bullying and harassment can take many different shapes and forms, which is why your managers and supervisors need to understand what it looks like and how to avoid claims against them. They also need to be able to have difficult conversations with their team members without fearing a bullying and harassment claim against them. Under the anti-discrimination law, it is against the law to treat anyone unfairly or harass them because of their race, gender, sexual orientation, age, physical or mental disability, marital status, family or carer’s responsibilities, pregnancy, religion, political opinion, national extraction, or social origin. HOW TO COMPLY WITH THE LAW As an employer, if an employee behaves in a discriminatory or harassing way, you are legally responsible unless you can prove you took all reasonable steps to prevent the discrimination or harassment from happening. However, bullying and harassment can often be subtle and discrimination can sometimes be unintentional. That is why it is important your people leaders understand the differences between bullying, harassment, sexual harassment, and discrimination, and how to ensure these behaviours don’t occur. One of the best ways to prevent bullying, harassment, and discrimination in the workplace is to provide training for all employees and ensure your company has a robust policy.
